These technologies assist us in providing the Platform and its functionality by processing information that you or other authorised users provide through the Platform. They do not independently collect personal information from you outside those interactions.
5. WHY WE COLLECT, HOLD, USE AND DISCLOSE PERSONAL INFORMATION
5.1 We collect, hold, use and disclose personal information where it is reasonably necessary to operate the Platform, provide our services, comply with legal obligations and conduct our business.
5.2 Depending on how you use the Platform, we may collect, hold, use and disclose personal information for one or more of the following purposes:
(a) to establish, administer and manage your Account;
(b) to provide, operate, maintain, support and improve the Platform and its features;

5.3 Unless otherwise permitted or required by law, we generally use and disclose personal information only for the primary purpose for which it was collected, for related purposes that you would reasonably expect, with your consent, or as otherwise authorised or required by law.
6. IF YOU CHOOSE NOT TO PROVIDE PERSONAL INFORMATION
You are not required to provide personal information to us. However, if you choose not to provide personal information that we reasonably require, we may be unable to:
(a) create or administer your Account;

(d) facilitate recruitment activities, including applications, candidate matching and communications through the Platform;
(e) provide customer support or respond to your enquiries; or
(f) otherwise provide the services you have requested.
7. AI AND AUTOMATED DECISION MAKING
7.1 Recruit RE uses AI-assisted and other automated technologies to support the operation of the Platform and enhance certain features and functionality.
7.2 Depending on the services you use, AI-assisted functionality may be used to:
(a) extract, organise and structure information contained in CVs, licences, certificates and other documents uploaded to the Platform;
(b) populate, enhance or update Candidate Profiles using information extracted from uploaded documents;
(c) assist Employers to create or improve Job Advertisements;
(d) identify, match, rank, prioritise or recommend Candidates for Job Advertisements based on information available through the Platform, including by generating relevance scores or other indicators where that functionality is available;
(e) improve search functionality and the presentation of search results; and
(f) support other recruitment-related functionality made available through the Platform from time to time.
7.3 AI-assisted functionality is intended to assist users of the Platform. It is not intended to replace human judgement or professional decision-making and does not make employment, recruitment or engagement decisions on behalf of Recruit RE, Employers or Candidates.
7.4 Automated matching and relevance scoring operate before any human review and may affect the order or prominence in which Candidate Profiles are presented to Employers, including which Candidate Profiles are surfaced in smart-match results, subject to the Candidate’s profile visibility settings. AI-generated scores do not prevent any Candidate Profile from being viewed by an Employer, and all applications submitted through the Platform are provided to the relevant Employer regardless of any AI-generated score or match result. Matching and scoring are based on the qualifications, skills, role type and stated location and availability information contained in your Candidate Profile and the relevant Job Advertisement. They do not use your age, gender, nationality or social media information. Employers remain responsible for reviewing Candidates and making all recruitment decisions.
7.5 Where AI-assisted functionality is used, the personal information processed may include, depending on the relevant feature:
(a) profile information;
(b) employment history;
(c) qualifications, licences, registrations and certifications;
(d) CVs, résumés and supporting documents;
(e) Job Advertisement information;
(f) application activity and recruitment interactions; and
(g) other information made available through the Platform that is relevant to the relevant functionality.
7.6 Recruit RE does not guarantee that AI-assisted functionality or any AI-generated output will be accurate, complete, current, free from error or suitable for any particular purpose. Employers remain responsible for reviewing Candidates, assessing suitability and making all recruitment decisions.
7.7 The Platform uses AI-assisted and other automated technologies to assist with document processing, profile enhancement, candidate matching, relevance scoring and other recruitment-related functionality described in this Privacy Policy. Where applicable privacy law requires additional information about our use of automated decision-making processes involving personal information, we will provide that information in accordance with those legal requirements.
8. CANDIDATE VISIBILITY AND ANONYMITY
8.1 The Platform may allow Candidates to manage the visibility of their Candidate Profile and indicate their availability for employment opportunities through features such as "Actively Looking" and "Not Looking" status settings, which you can select when creating your Candidate Profile and change at any time through your profile settings.
8.2 Candidates whose status is set to "Not Looking" do not appear in Employer candidate search results or smart-match results.
8.3 These settings are intended to give Candidates greater control over how their Candidate Profile and personal information are displayed within the Platform. The information visible to Employers or recruiters may vary depending on the visibility settings selected, the functionality available on the Platform at the relevant time and the manner in which you interact with the Platform.
8.4 Recruit RE will take reasonable steps to apply the visibility settings selected by a Candidate. However, we cannot guarantee that visibility settings will prevent all access to or discovery of a Candidate Profile or other personal information in every circumstance, including as a result of system maintenance, software defects, unauthorised activity or circumstances beyond our reasonable control.
8.5 If you apply for a Job Advertisement or otherwise choose to share your information with an Employer or recruiter through the Platform, your application, Candidate Profile (including your CV, qualifications and supporting documents) and other personal information relevant to that recruitment process will be disclosed to that Employer or recruiter, regardless of your broader profile visibility settings.
8.6 Where anonymous profile functionality is available, it is intended to limit the personal information displayed to Employers before you choose to participate in a recruitment process. Depending on the functionality available, this may include masking information such as your name, photograph and contact details. Anonymous profile functionality is intended to reduce the visibility of your identifying information but does not guarantee anonymity in all circumstances. Your identifying information will be disclosed where you apply for a Job Advertisement, otherwise choose to share your information with an Employer or recruiter, consent to disclosure, or where disclosure is otherwise authorised or required by law.
9. WHO WE DISCLOSE PERSONAL INFORMATION TO
9.1 We may disclose personal information where reasonably necessary to operate the Platform, provide our services, facilitate recruitment activities, comply with legal obligations or otherwise as described in this Privacy Policy.
9.2 Depending on how you use the Platform, we may disclose personal information to:

ix. other technology or professional services that support the operation of the Platform.
9.3 Where an Employer initiates a video interview through the Platform, we provide your name, email address and telephone number to our video interviewing provider (Viddi) so that the interview invitation can be issued, and Viddi may contact you directly by email to facilitate the interview. You are not required to create a separate account with Viddi. Recruit RE does not disclose personal information to identity verification providers, licensing verification providers, advertising networks or data brokers, and does not use third parties to verify a Candidate's identity, qualifications, licences or registrations.
(a) Professional advisers
Our lawyers, accountants, auditors, insurers, consultants and other professional advisers.
(b) Regulators and government authorities
Courts, regulators, government agencies, law enforcement bodies or dispute resolution bodies where disclosure is authorised or required by law or is reasonably necessary to protect our legal rights or comply with legal obligations.
(c) Business transactions
Prospective purchasers, investors, financiers or successors in connection with an actual or proposed merger, acquisition, restructuring, financing or sale of all or part of our business, provided appropriate confidentiality obligations apply.
(d) Other disclosures
Any other person or organisation:
i. with your consent;
ii. at your direction; or
iii. where otherwise authorised or required by law.
9.4 We take reasonable steps to ensure that service providers who process personal information on our behalf are subject to appropriate contractual, technical and organisational measures designed to protect personal information and to handle it only for authorised purposes.
9.5 Where personal information is disclosed to an Employer or recruiter as part of a recruitment process, that Employer or recruiter is responsible for its own handling of that personal information in accordance with its own privacy obligations and policies. Once personal information has been disclosed, Recruit RE does not control how that Employer or recruiter subsequently collects, uses, stores, discloses or otherwise handles that information.
10. OVERSEAS DISCLOSURE OF PERSONAL INFORMATION
10.1 The production Platform and its primary hosting environment and databases are hosted in Australia. However, some of the third-party service providers that assist us in operating the Platform (including providers of CRM, transactional email, video interviewing, AI, payment processing and analytics services) may store, process or access personal information outside Australia, including in jurisdictions in which those providers operate. As a result, your personal information may be transferred to, stored in or accessed from countries outside Australia in connection with the services described in section 8.
10.2 Before disclosing personal information to an overseas recipient, we take reasonable steps in the circumstances to ensure that the recipient handles personal information in a manner that is consistent with the Privacy Act and the APPs, including through appropriate contractual, technical and organisational measures where appropriate.
10.3 Where we disclose personal information to overseas service providers, we do so for the purposes described in this Privacy Policy, including operating the Platform, providing our services, supporting AI-assisted functionality, processing payments, communicating with users and maintaining the security and performance of the Platform.
10.4 The countries in which your personal information is processed, stored or accessed may change from time to time as our service providers and technology infrastructure evolve. We will update this Privacy Policy where appropriate to reflect any material changes to our overseas disclosure practices or the countries in which personal information is processed, stored or accessed.
11. COOKIES, ANALYTICS AND SIMILAR TECHNOLOGIES
11.1 We use cookies, tags and similar technologies to collect information about how the Platform is accessed and used.
11.2 These technologies help us to:
(a) provide, operate and maintain the Platform;
(b) recognise returning users and remember user preferences;
(c) authenticate users and maintain the security of Accounts;
(d) understand how users access and interact with the Platform;
(e) monitor, analyse and improve the performance, functionality and user experience of the Platform;
(f) develop, test and improve our products and services; and
(g) where permitted by law, measure the effectiveness of our communications and marketing activities.
11.3 We use third-party analytics and performance monitoring providers (currently Google Analytics 4 and Mixpanel) to assist us in understanding how the Platform is used, improving our services, measuring the effectiveness of our communications and maintaining the performance and security of the Platform.
11.4 Analytics technologies operate behind a cookie consent banner: analytics scripts do not load, and no analytics tracking requests are made, unless you accept analytics cookies. You can change your consent choice at any time through the cookie settings on the Platform. Analytics events are configured to use internal identifiers and categorical values only and are not intended to contain your name, email address or free-text content.
11.5 We also record certain key account events (such as the submission of a Job Application) on our own systems for authenticated users in order to maintain the integrity, security and operation of the Platform. These records are associated with your Account rather than with cookies. The Platform does not currently use advertising, remarketing or tracking pixels, and we do not currently offer mobile applications.
11.6 You can control or disable cookies through your browser settings and, where available, any cookie preference tools we make available. However, if you disable certain cookies or similar technologies, some features or functionality of the Platform may not operate as intended.
11.7 Where required by applicable law, we will obtain your consent before using cookies or similar technologies that are not strictly necessary for the operation of the Platform. You may withdraw or modify your consent at any time through any cookie preference tools we make available.
12. DIRECT MARKETING AND COMMUNICATIONS
12.1 We may send you communications that are reasonably necessary to establish, operate, administer and secure your Account or the Platform. These communications may include:
(a) Account registration and verification messages;
(b) password reset and security notifications;
(c) application updates and recruitment-related notifications;
(d) billing and payment notices;
(e) updates relating to the Platform, your Account or our services; and
(f) notices about changes to our Terms of Service, this Privacy Policy or other important policies.
12.2 Service communications are an important part of providing the Platform and generally cannot be opted out of while you maintain an Account.
12.3 Where permitted by applicable law, we may send you marketing, promotional, product update or industry-related communications about Recruit RE, the Platform or related services. We will only send marketing communications in accordance with the Spam Act 2003 (Cth) and other applicable laws, including where we have your consent or where consent is otherwise not required.
12.4 You may opt out of receiving marketing communications at any time by:
(a) using the unsubscribe facility included in the relevant communication;
(b) updating your communication preferences through the Platform, where available; or
(c) contacting us using the details set out in this Privacy Policy.
12.5 Opting out of marketing communications does not affect our ability to send service communications that are reasonably necessary to administer your Account, provide and secure the Platform, comply with legal obligations or otherwise manage our relationship with you.
12.6 If you unsubscribe from marketing communications, you will not be re-subscribed unless you choose to opt back in. Push notifications and other optional notification preferences made available through the Platform can be managed by you at any time through your Account or notification settings.
13. STORAGE, SECURITY AND RETENTION
13.1 We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification and disclosure, in accordance with the Privacy Act and the APPs.
13.2 The security measures we use may include administrative, technical and physical safeguards appropriate to the nature of the personal information we hold and the risks associated with its processing. These measures may include:
(a) authentication and access controls;
(b) role-based and least-privilege access permissions;
(c) encryption and secure transmission of information, where appropriate;
(d) system monitoring, logging and audit controls;
(e) secure management of credentials and secrets;
(f) backup and disaster recovery processes; and
(g) security assessments and appropriate due diligence in relation to third-party service providers.
13.3 No method of transmitting information over the internet or storing information electronically is completely secure. While we take reasonable steps to protect personal information, we cannot guarantee the absolute security of information transmitted to or stored on the Platform.
13.4 We retain personal information only for as long as reasonably necessary to fulfil the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, establish, exercise or defend legal claims, enforce our legal rights and obligations, or as otherwise permitted or required by law.
13.5 If you delete your Account, your Account is deactivated immediately and your Candidate Profile or Employer profile ceases to be visible or searchable on the Platform. Your Account and associated personal information are then retained in a deactivated state for 30 days, during which you may request that your Account be reactivated by contacting us. If your Account is not reactivated within that period, your Account and associated personal information are permanently and automatically deleted from our live systems, and your email address becomes available for re-registration. Certain categories of information may nevertheless be retained where permitted or required by law, having regard to:
(a) our legal and regulatory obligations;
(b) tax, accounting and financial reporting requirements;
(c) dispute resolution and the establishment, exercise or defence of legal claims;
(d) fraud prevention, security and audit requirements; and
(e) the operation of backup and disaster recovery systems.
13.6 We may retain certain categories of information after your Account is closed, including:
(a) transaction, billing and payment records;
(b) communications and customer support records;
(c) system logs, audit trails and security records;
(d) records required to comply with legal obligations or respond to regulatory requirements; and
(e) copies of information held in encrypted system backups, which are automatically overwritten on a short, fixed backup cycle, meaning information deleted from our live systems ages out of those backup systems within that period rather than being erased immediately.
13.7 Where permitted by law, we may de-identify or aggregate personal information so that it no longer identifies an individual. We may use or disclose de-identified or aggregated information for analytics, reporting, product development, service improvement, research, statistical analysis and other lawful business purposes.
14. ACCESS AND CORRECTION
14.1 You may request access to the personal information we hold about you and request that we correct any personal information that is inaccurate, out-of-date, incomplete, irrelevant or misleading.
14.2 To request access to or correction of your personal information, please contact us using the details set out at the end of this Privacy Policy. We may need to verify your identity before processing your request to protect your privacy and the security of your personal information.
14.3 We will respond to requests for access or correction within a reasonable time and in accordance with the Privacy Act and the APPs.
14.4 In some circumstances, we may refuse a request for access to or correction of personal information where permitted or required by applicable law. If we refuse your request, we will provide written reasons (unless we are not required to do so by law) and explain the avenues available to you to make a complaint.
14.5 You can also access, update and correct your profile information at any time directly through your Account settings on the Platform.
15. PRIVACY COMPLAINTS
15.1 If you believe that we have breached the Privacy Act, the APPs, or otherwise mishandled your personal information, you may make a privacy complaint by contacting us using the details set out at the end of this Privacy Policy.
15.2 Please provide sufficient information about your complaint to enable us to investigate the matter. We may contact you to request additional information where reasonably necessary.
15.3 We will acknowledge your complaint within 7 days of receipt, investigate it, and endeavour to provide you with a substantive response within 30 days. If we require additional time, we will let you know and keep you informed of our progress.
15.4 If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) or another regulator with jurisdiction over your complaint.
16. NOTIFIABLE DATA BREACHES
16.1 If we become aware of a suspected or actual data breach involving personal information, we will promptly assess and investigate the incident and take reasonable steps to contain, mitigate and remediate its impact where appropriate.
16.2 Where we determine that an eligible data breach has occurred for the purposes of Part IIIC of the Privacy Act, we will comply with our obligations under the Notifiable Data Breaches scheme, including by:
(a) preparing any statement required by law;
(b) notifying affected individuals where required; and
(c) notifying OAIC, where required.
16.3 We maintain and periodically review security measures and processes designed to assist in preventing, detecting, responding to and recovering from security incidents involving personal information.
